These Terms of Service ("Terms") govern your use of byoppools.com (the "Site"), operated by BYOP by Monarch Pools & Outdoor Living ("BYOP," "we," "us"), a fixed-price pool program built and warrantied by Pools R Us LLC (dba Monarch Pools & Outdoor Living), a licensed Nevada contractor (NV Contractor License # 82091). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
All content on the Site — including package prices, add-on prices, monthly payment figures, timelines, renderings, and the interactive pool builder — is provided for information and planning purposes only. Nothing on the Site is a binding offer, quote, or contract. A binding agreement exists only when you and Monarch Pools & Outdoor Living sign a written construction contract.
The eight-week build schedule — 60 working days, with no work performed on weekends — refers to construction time from excavation to startup under normal conditions, and excludes permitting and HOA approval timelines, weather delays, utility work by third parties, change requests, inspection scheduling, and other events outside our reasonable control. Timelines are targets, not guarantees, except as expressly stated in a signed construction contract.
Fixed-price packages assume a flat, accessible lot with at least 42 inches of backyard access for excavation equipment, and a main electric panel and gas meter within approximately 100 feet of the pool equipment location. Sloped or hillside lots, restricted access, soil conditions, and other site factors may require custom engineering and pricing. All projects are subject to a site evaluation.
We are not a lender and do not make credit decisions. Financing is offered by independent third-party lenders. Monthly payment figures shown on the Site are illustrative estimates based on 7.20% APR over 240 months and are not an offer of credit; your actual rate, term, and payment depend on the lender's underwriting and your creditworthiness. All financing is on approved credit (OAC). Pre-qualification inquiries described as "soft pulls" are performed by the lender under the lender's own terms.
By submitting a form on the Site and checking the consent box, you expressly consent to receive calls, text messages, and emails about your inquiry and project from BYOP and Monarch Pools & Outdoor Living at the phone number and email you provide, including messages sent using automated technology. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any text, using the unsubscribe link in any email, or contacting us at BYOPleads@gmail.com.
Pool renderings, blueprints, dimensions, and color visualizations in the builder are schematic illustrations. Actual finished pools vary in appearance, and finish colors (including pebble and coping samples) render differently on screens than in sunlight and water. Physical samples are provided during design.
Concept imagery. Images in the Design Studio, the "See Your Pool Now" feature, and elsewhere on the Site may be AI-assisted or computer-generated concept visualizations. They are provided for illustration only; they are not photographs of completed BYOP projects, are not renderings of your specific lot or configuration, and are not construction documents. Layout, colors, materials, water tone, lighting, equipment placement, decking, landscaping, and surroundings shown in any concept image are illustrative and will vary with site conditions, material availability, and your final selections. Options you select may not be depicted, and elements depicted may not be included in your package. No concept image creates any promise, warranty, or representation about the appearance of a finished pool. The final design, dimensions, materials, and appearance of your project are defined solely by your signed construction contract and stamped engineering plans.
The Site and its content — including text, graphics, logos, the pool builder, renderings, and code — are owned by or licensed to BYOP by Monarch Pools & Outdoor Living and are protected by copyright, trademark, and other laws. You may use the Site for personal, non-commercial shopping and research. You may not scrape, copy, republish, or create derivative works from the Site without our written permission.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THIS SECTION APPLIES TO THE WEBSITE ONLY; CONSTRUCTION WARRANTIES ARE PROVIDED SEPARATELY IN A SIGNED CONSTRUCTION CONTRACT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYOP AND MONARCH POOLS & OUTDOOR LIVING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING FROM THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER NEVADA LAW, INCLUDING RIGHTS UNDER A SIGNED CONSTRUCTION CONTRACT OR NRS CHAPTER 624.
You agree to indemnify and hold harmless BYOP by Monarch Pools & Outdoor Living, Monarch Pools & Outdoor Living, and their owners, employees, and agents from claims arising out of your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction. Disputes under a signed construction contract are governed by that contract, including any rights and procedures under NRS Chapter 624 (Nevada State Contractors Board).
BYOP by Monarch Pools & Outdoor Living is committed to making the Site usable by everyone. We build to the Web Content Accessibility Guidelines (WCAG) 2.1 AA as our standard — including keyboard-navigable controls, text alternatives, sufficient color contrast, and reduced-motion-tolerant design — and we review the Site on an ongoing basis. If you encounter any barrier using the Site, or need this information in an alternative format, contact us at BYOPleads@gmail.com and we will provide the information you need and work to fix the barrier promptly.
We may update these Terms at any time by posting a revised version with a new "Last Updated" date; continued use of the Site constitutes acceptance. If any provision is found unenforceable, the remainder stays in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site.
